Dad’s Pies Metro Mart Competition (“Promotion”)

Terms and Conditions

  1. Instructions on how to participate in the Promotion form part of these Terms and Conditions. Participation in this Promotion is deemed to be acceptance of these Terms and Conditions.
  2. The Promoter is Dad’s Pies Ltd, 57 Forge Road, Silverdale, Auckland 0932 (“Promoter”). To contact the Promoter, please email or telephone on 09 421 9027.
  3. The Promotion is open to New Zealand residents who are ages 18 years or over excluding employees and contractors of the Promoter, the employees or contractors of any agency or retailer involved with this Promotion, and the immediate families of such employees and contractors (“Entrant”).
  4. The Promotion commences from 12.00am on Monday 12th February 2024 and closes at 11.59pm on Sunday 10th March 2024 (“Entry Period”). The final prize draw will be at 10am on Monday 11th March 2024.
  5. To enter the Promotion, Entrants must during the Entry Period:
    1. purchase any Dad’s Pies Classic, Gourmet or Sausage Roll product from a participating Metro Mart store; and
    2. fill in specially marked entry pads; and
    3. deposit your entry in specially marked entry boxes.
  6. An Entrant may submit multiple entries over the Entry Period for each qualifying purchase. Entries must be received by the Promoter before 11.59pm on Sunday 10th March 2024. Entries are deemed to be received at the time they are received by the Promoter, and not at the time of transmission by the Entrant. Any entries received outside of the Entry Period will be null and void and will not be entered into the Promotion. There will be 3 prizes to win in total and all prizes will be drawn at 10am on the 11th March 2024.
  7. Each winner will win receive a Prezzy Card with $390 NZD loaded on it. The total prize pool is $1,170. There are 3 prizes available to win. Any terms and conditions applicable to the Prezzy Card including any expiry dates or limitations of use will apply. Refer to the Prezzy website for more information
  8. The winners will be notified by a phone call on the number supplied in their entry and by an email, emailed to the email address supplied in their entry. In the event that an ineligible entry is drawn, or the Promoter is unable to contact a winner within 48 hours of the Prize draw, having made reasonable attempts to do so, the Promoter may deem that winner’s entry invalid and select a new winner on the same terms as the original Prize draw. If a winner cannot accept or take part in the Prize for any reason, the Prize will be void and no compensation will be provided.
  9. Failure by the Promoter to enforce any of its rights at this stage does not constitute a waiver of those rights.
  10. A Prize cannot be exchanged for cash.
  11. The Promoter is not liable for any loss, damage or injury suffered (even if caused by negligence) as a result of any winner accepting and/or using a Prize, except for any liability which cannot be excluded by law.
  12. In the event that the Prize or any part of the Prize becomes unavailable for any reason beyond the Promoter’s control, the Promoter may in its sole discretion decide to provide an alternative prize.
  13. The Promoter reserves the right to disallow entries in its absolute discretion and without giving reasons. If an entry is deemed inappropriate or offensive, it will be removed by the Promoter in its sole discretion and the Entrant will not be eligible to win a Prize.
  14. The Promoter reserves the right, at any time, to verify the validity of claims and determine the eligibility of entrants (including an Entrant’s identity and age and that the entry is the Entrant’s original work) and to disqualify any entry or refuse to award a Prize where false or misleading details have been given by an Entrant, or where an Entrant has behaved in a fraudulent or dishonest manner, or otherwise than in accordance with these terms and conditions or the spirit of the Promotion.
  15. The Promoter reserves the right to disqualify any individual who submits an entry that is not in accordance with these terms and conditions, or who is involved in any way in interfering or tampering with the conduct of this Promotion, has breached any of these terms and conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion.
  16. Neither the Promoter nor any other entity associated with this Promotion will be responsible for any late, lost, misdirected or incorrectly submitted entries, including but not limited to entries not received due to technical problems or human error.
  17. The Promoter collects personal information in order to conduct the Promotion, contact winners, and deliver prizes. The Promoter may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to New Zealand regulatory authorities. Eligibility to win a Prize is conditional on providing this information. By entering the promotion, the Entrant consents to the Promoter, unless otherwise advised, using the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. Under the Privacy Act 2020, entrants have the right to access and correct any such personal information.
  18. By entering this Promotion, Entrants grant the Promoter a non-exclusive licence to use the content of their entry, or any part of the content of the entry, in any way the Promoter wishes (including modifying, adapting, copying, cropping, retouching, editing, publishing, broadcasting or communicating the entry whether in original or modified form in whole or in part) in all media for the purposes of the Promoter’s business on its website, social media or in any marketing campaign, without payment to the Entrant of royalties or compensation. If requested by the Promoter, eligible Entrants agree to sign any further documentation required by the Promoter to give effect to this clause.
  19. By entering this Promotion, Entrants consent to the Promoter dealing with their entry content in any way that may otherwise infringe the Entrant’s moral rights and agree not to assert their moral rights (wherever such rights are recognised) in respect of their entry against the Promoter or its assigns, licensees or successors.
  20. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting this Promotion (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.
  21. Except for any liability that cannot be excluded by law, the Promoter (including its officers, directors, shareholders, employees, advisors, assignees, agents, licensees, representatives, advertising and promotional agencies), excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where attributable to any of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected ; (d) any variation in the Prize; (e) any tax liability incurred by a claimant or entrant; or (f) use of a Prize.
  22. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may in its sole discretion cancel, terminate, modify or suspend any aspect of the Promotion (including any Prize or term), or invalidate any affected entries.
  23. All decisions made by the Promoter, its employees or agents are final, and no correspondence will be entered into.
